The Fader.com promotion is a "Promotion"

The winner of the Promotion draw will receive a pair of tickets to see multiple artists perform at the (RED)NIGHTS concert performance at Carnegie Hall, New York, NY on October 4th, 2009 (the "Show"). 

The promotion begins as follows:

Fader.com: On September 24th, and ends at midnight on September 28th (“Fader.com Promotion Period").

The Fader.com Promotion Period is referred to as the "Promotion Period". The "Promoter" in connection with their respective Promotion.

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF
WINNING. The Promotions are open to legal residents 18 years of age or older as of September 1st, 2009 who are residents of New York City or the following New York counties: Nassau, Suffolk or Westchester, or Bergen County, New Jersey or Fairfield County, Connecticut (the "Eligible Area").  If you are resident outside the Eligible Area your entry in the Promotions is not valid. These sweepstakes are void where prohibited by law.

(RED)'s INVOLVEMENT: The Persuaders, LLC  ("(RED)") is not responsible for or involved in selecting the winners or administering the Promotions. (RED) has provided the prizes and where an entrant opts into the (RED) mailing list pursuant to mechanism present on the applicable the Promotion web page, (RED) may then communicate with the entrant pursuant to the opt-in mechanisms associated with Sweepstakes and (RED)'s applicable privacy policy.  All other aspects of the Sweepstakes are the responsibility of the applicable Publisher.


TO ENTER. Visit Fader.com at www.thefader.com during the applicable Promotion Period as stated above and follow the instructions to enter the Carnegie Hall (RED)NIGHTS sweepstakes ("Sweepstakes"). Entries must be received by end times and dates stated above in connection with the applicable Promotion. Limit one entry per person per Promotion. Entry by third party or by sweepstakes engine shall not be permitted.  Although subsequent attempts to enter may be received, only entrant's first entry during the specified Sweepstakes entry period will count.  No employees, directors, officers and agents of the applicable Promoter, (RED), and their subsidiary companies, sales representatives, advertising and promotion agencies involved in these Sweepstakes; and members of the immediate families (parent, child, sibling and spouse of each) or households of any of the above are prohibited from entering the Sweepstakes. The Promoters and (RED) and/or their agents are not responsible for any lost, late, misdirected or incomplete entries.

 
Neither the Promoters, (RED), nor their respective officers, directors, employees or agents are responsible for interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or telephone transmissions or technical failures, Internet service provider/network/website accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including, without limitation, the incomplete, incorrect or inaccurate capture of entry information. The Promoter of the Promotion in question reserves the right, in its sole discretion, to disqualify any individual found tampering (or attempting to tamper) with the entry process, the website, or the Sweepstakes. Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the Sweepstakes is in violation of criminal and civil laws and should such an attempt be made, The Promoters and (RED) reserve the right to seek remedies and damages from any such entrant to the fullest extent permitted by law, including, without limitation, criminal prosecution. With regards to their respective Promotion, In case of dispute as to identity of entrant, entry will be declared made by the authorized email account holder at the time of entry, who must comply with these Sweepstakes Rules. the Promoter's each reserve the right, at their sole discretion, to cancel/suspend/modify their Sweepstakes, if the same becomes corrupted in any manner, or due to fraud or other occurrences beyond the Promoter's  control it cannot be conducted as originally planned. In the event of cancellation, the Promoter of the applicable Promotion will award the prize in a random drawing from all eligible entries received prior to cancellation.


DRAWING. The winner of the prize for each Sweepstake will be randomly selected in a
drawing by each Promoter on or about September 28th from among all eligible entries received by the applicable Promoter, whose decisions are final and binding in all matters relating to the Sweepstakes.
The potential winner will be notified by email from the applicable Promoter. Odds of winning a prize depend upon 
the number of eligible entries received.


PRIZE. Grand Prize: The Promotion has one Grand Prize consisting of two (2) tickets to the New York, New
York (RED)NIGHTS concert performance at Carnegie Hall, New York on October 4th, 2009. 


Total Approximate Retail Value of each Grand Prize is up to $150. Winner and guest must be able to travel on applicable (RED)NIGHTS concert performance concert, or prize will be forfeited in its entirety and may be awarded to an alternate winner, time permitting. All travel-related expenses, including, but not limited to, ground transportation, meals, gratuities and incidental hotel and personal expenses, are solely the responsibility of winner. The applicable Promoter and (RED) will not replace any lost, mutilated, or stolen tickets or certificates. Any difference between stated approximate retail value and actual value of prize will not be awarded. Winner and guest must comply with all (RED)NIGHTS concert performance venue security requirements. All entrants understand that travel, whether in civilized or remote areas and whether by plane, automobile, or other conveyance, or by foot, on land and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature or other agencies, known or unknown. Winner understands that these risks may be present before, during and after the Show. Winner and guest must accept the terms and conditions concerning the prize, or the prize in its entirety is subject to forfeiture. By participating in the Sweepstakes, entrants agree to indemnify and hold harmless the applicable Promoter, (RED) and affiliates, subsidiaries, agents (including, without limitation, their advertising and promotion agencies), representatives and permitted assigns, and each of their respective directors, employees and officers, from and against any and all injuries, losses, damages, claims and actions of any kind arising from or relating to participation in the Sweepstakes, or acceptance, possession, use, misuse or non-use of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages.

Winner and guest must sign a Liability Release in which they accept the risk in attending Show including, but not limited to, personal injury and/or death, acknowledge that his/her participation in this prize event is voluntary, and he/she assumes the risk of such factors and occurrences, and agrees that the Promoter and (RED) shall not be in any way responsible for any resulting injury and/or death. Promoter reserves the right in its sole discretion to suspend or cancel the participation of any winner or guest due to non-compliance with any security procedure or inappropriate behavior or misconduct. The Grand Prize will be awarded provided it is claimed properly in accordance with these Sweepstakes Rules. No transfer of prize allowed. No cash redemption of prize. Promoter and/or (RED) reserves the right to substitute prize for one of equal or
greater value if prize becomes unavailable. If an eligible minor wins the Grand Prize, the Grand Prize will be
awarded on his/her behalf to his/her parent or legal guardian. The Grand Prize winner (and his/her parent/legal guardian if winner is an eligible minor) will be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legal, at Promoter and/or (RED)'s election, a Publicity Release, within two (2) days of the date of the prize notification. Non-compliance within this time period may result in disqualification and an alternate winner may be selected, if time permits, from among the remaining entries in the drawing pool. If the prize notification or prize is returned as undeliverable, or any prize documentation is not submitted as required by Sponsor, the corresponding prize will be forfeited.

GENERAL. Taxes on each Grand Prize are solely the responsibility of winner. By participating in this
promotion, entrants agree to abide by and be bound by these Sweepstakes Rules and the decisions of the Promoters, which are final in all matters relating to this promotion. Participants waive the right to assert as a cost of winning a prize any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize, or from use, misuse, acceptance or possession of said prize. By participating, entrants agree to release and hold The applicable Promoter and (RED), and their respective affiliates, subsidiaries, agents (including, without limitation, their advertising and promotion agencies), representatives and permitted assigns, and each of their respective directors, employees and officers (collectively "Releasees"), harmless from and against any and all liability arising from or in connection with participation in the applicable Promotion, any breach of entrant's warranties and representations in these Sweepstakes Rules, any use by the applicable Promoter and/or (RED) or their respective agents of the entry submitted, or the awarding, receipt or use of any prize. Entry constitutes permission for the applicable Promoter and (RED) and their respective designees to use winner's name, likeness, voice, performance, and information concerning winner's hometown and state, for advertising and promotional purposes in any and all media throughout the world in perpetuity at their discretion without additional compensation, unless prohibited by law. By entering, entrants further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Rules, participant's rights and obligations, or the rights and obligations of the Promoter in connection with the applicable Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in New York, New York.

DATA COLLECTION. The Promoters may collect and use information from you pursuant to your entry into the applicable Sweepstake pursuant to the privacy policy and terms of use links to which are located on the Promoter's webpage where the applicable Sweepstakes entry is located. (RED)'s collection and use of personal information from you if you opt into receiving information from (RED) shall be subject to (RED)'s privacy policy located at http://www.joinred/Privacy.aspx.

LIMITATIONS OF LIABILITY. The Releasees are not responsible for any attempt by an entrant or other individual to deliberately damage or undermine the legitimate operation of the Promotions, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, The Releasees, reserve the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Should the applicable Promoter failure to enforce any term of these Sweepstakes Rules in connection with their Promotion such failure shall not constitute a waiver of that provision. Participant engaging in any of the foregoing activities may be disqualified and upon disqualification will forfeit any prize won.
